FAQ on Children Education Allowance, OTA/NDA, Honorarium/Fee, Leave.

Children Education Allowance

1. Whether reimbursement of Children Education Allowance is admissible for the:
(a) Nursery/LKG/UKG as there is no provision of recognition of these classes in most of the States/UTs;
Reimbursement is permissible only if the child is studying in a recognised educational institution.


(b) Third child if either of the first two children is disabled to the extent that he/she cannot go to school;
Reimbursement is allowed to only the two eldest surviving children of the Government servant except when the 2nd child birth results in multiple births or the 3`d child is born due to failure of sterilization operation.

(c) The children borne out of second marriage or the children of second wife/husband in additions to children from first marriage;
Reimbursement is allowed to only the two eldest surviving children of the Government servant.

(d)  Entitlement of number of Note Books.
Reimbursement is permissible for any number of note books as may be prescribed by the recognised educational institution.

OTA/NDA

2. The reasons for not enhancing rates of OTA/NDA
The 5th and the 6th Central pay Commission did not recommend enhancement of rates of OTA/NDA.

Honorarium/Fee

3.  Whether honorarium is payable to the Chairperson/Members of the DPC and also such other Departmental Committees, viz., Committee on Sexual Harassments at work place, etc.?
In terms of the provisions of FR 46 (b), the Central Government may grant or permit a Government servant to receive an honorarium as remuneration for work performed which is occasional or intermittent in character and either so laborious or of such special merit as to justify a special reward. Except when special reasons, which should be  recorded in writing, exist for a departure from this provision, sanction to the grant or acceptance of an honorarium should not be given unless the work has been undertaken with the prior consent of the Central Government and its account has been settled in advance.

Guidelines for payment of Honorarium under FR 46 (b) have already been laid down inter alia vide this Department’s OM No.17011/9/85- Estt. (AL), dated 23.12.1985 and OM No. 17020/1/91- Estt. (AL), dated 18.11 .1991. It has also been clarified that no honorarium should be granted for temporary increases in work.

4. Whether retention of “Fee” for delivering lectures in Government/private bodies is permissible? As per para 6 of DoP&T’s O.M.No. I 6013/1/79-Estt.(AL) dated 11th February, 1980, payments received by Government servants as income from books, articles, papers and lectures on literary, cultural, artistic, technological and scientific subjects including management sciences; will not be subject to crediting one-third of the amount to the general revenues.

Establishment (Leave) Section:

5. Whether male Government servant, who is single parent, can be allowed Child Care Leave? No. CCL can be granted to female employees only.

6.  Whether Bond on Study Leave can be transferred from Central Government to State Government?
No. Bond executed by the Government servant while proceeding on study leave cannot be transferred on his/her appointment in State Government/PSU/Autonomous bodies.

7.  What is the limit of leave encashment while availing LTC by dependents or spouse within the same block year?
The Government Servants governed by the CSS (Leave) Rules, 1972 and entitled to avail LTC may en-cash earned leave up to 10 days at the time of availing both types of LTCs., i.e., `Hometown’ and `Anywhere in India’. However, when the one and the same LTC is being availed of by the Government Servant and his family members separately in a block year, encashment of leave would be restricted to one occasion only.

OFFICE MEMORANDUM

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Relaxation to travel by private airlines to visit J&K.

The undersigned is directed to refer to this Ministry’s O.M. No.31011/3/2014- Estt.(A-1V) dated 26th September, 2014. It has been decided that the Government servants while availing Leave Travel Concession (LTC) to Jammu and Kashmir (J&K) under the special dispensation scheme allowed by the aforesaid O.M. may also travel
by private airlines subject to the following conditions:-

(i) Officers entitled to travel by air may also travel by private airlines from their headquarters;

(ii) Officers not entitled to travel by air may be permitted to travel by private airlines between Delhi /Amritsar and any place in J&K.

2. Air travel by private airlines is to be performed in Economy Class only an at LTC- 80 fare of Air India or less.

3. Air Tickets to be purchased directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is
authorized as per DoPT’s O.M. No. 31011/6/2002-Estt.(A) dated 02.12.2009) while undertaking LTC journey. Booking of tickets through other agencies is not permitted.

4. All other conditions prescribed in this Ministry’s O.M. No. 31011/3/2014-Estt.(AIV) dated 26.09.2014 would continue to apply.

5. The order will remain in force for a period of one year from the date of issue of this order.

To make the general public and concerned stakeholders aware of the office timing in Government Offices, Department of Personnel & Training has posted this information on the Home page of its website www.persmin.nic.in. The matter regarding posting/ uploading of “Working Hours” etc. on the Websites of Indian Government has been considered in this Department in order to provide information to the citizens staying/residing abroad who seek Indian Government Websites.


2. All Ministries/Departments are advised to post/upload “Working Hours”, Holidays List and Public dealing hours, if any, on the Home Page of their Web-sites. Offices under these Ministries/ Departments who are having their own website may also be advised accordingly.

Subject :- Inviting suggestions for the proposed Scheme of Swantah Sukhaya

It has been decided to launch an initiative to provide a platform to Government officials to design and implement projects or schemes of their choice on voluntary basis which would give them a sense of self satisfaction and achievement Rules permit a Government servant to take up honorary work of social or charitable
nature etc.

The draft guidelines are attached. Suggestions are invited about its methodology and also its name. The existing name Swantah Sukhaya is on the lines of initiative from the Gujarat Government where it has been successfully implemented since 2004 and has also been documented. The Dopt order says, during the period probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions to pass examinations and tests as Government may deem fit as a condition to satisfactory completion of the probation.

Subject: Introduction of mandatory Induction Training for Probation clearance-regarding.

The undersigned is directed to refer to this Department’s O.M of even number dated 21 July, 2014 wherein consolidated instructions on Probation/ Confirmation in Central Services were issued for ready reference to all concerned. As per extant instructions during the period probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions to pass examinations and tests as Government may deem fit as a condition to satisfactory completion of the probation.


2. It has been decided that in all cases of direct recruitment there should be a mandatory induction training of atleast two weeks duration. Successful completion of the training may be made a pre-requisite for completion of probation. The syllabus for the training may be prescribed by the Cadre authorities and the Training Division of DOPT can be consulted, if required.

3. The recruitment rules for all posts, wherever such a provision does not already exist, may be amended to provide for such mandatory training. Till such time as the Recruitment Rides are amended, a clause on the above lines may be included in the offer of appointment.

Subject:- Consolidated Instructions on compassionate appointment — regarding.

The undersigned is directed to invite attention to this Department’s O.M. of even number dated 16th January, 2013 vide which Consolidated Instructions on compassionate appointment were issued. In Part —A of the Proforma annexed at pages 15-18 therein, the candidate applying for compassionate appointment has to furnish a declaration/undertaking to the effect that the facts given by him/her are, to the best of his/her knowledge, correct and if any of the facts herein mentioned are found to be incorrect or false at a future date, his/her services may be terminated. The candidate has to also furnish a declaration that he shall maintain properly the other family members who were dependent on the deceased government servant/member of the Armed Forces mentioned against 1(a) of Part-A of this form and in case it is proved at any time that the said family members are being neglected or not being properly maintained by him/her, his/her appointment may be terminated. This declaration/undertaking has to be countersigned by two permanent government employees.


2. The matter has been examined in this Department. It is felt that the declaration/undertaking furnished by the applicant as at page 17 of the aforesaid Consolidated Instruction is sufficient and that there is no need of getting it countersigned by two permanent government employees. Accordingly, it has been decided to delete this provision of getting the declaration/undertaking furnished by the applicant countersigned by two permanent government employees (page 18 of the Consolidated Instructions on Compassionate Appointment). This may be brought ) to the notice of all concerned for information, guidance and necessary action.

OFFICE MEMORANDUM

Subject: Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment w.e.f. 01.07.2014.

In continuation of this Department’s OM No.42/10/2014-P&PW(G) dated 7th May, 2014, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f. 1.7.2014 to the following :

(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/S2/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000, Rs.750 & Rs.650 for Group A, B. C & D respectively w.e.f 4th June, 2013 vide OM No.1/10f2012-P&PW(E) dt. 27th June, 2013 are entitled to Dearness Relief @ 212% w.e.f. 1.7.2014.

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s 0M No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR @ 204% w.e.f. 1.7.2014.

(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in
receipt of Ex-gratia payment of Rs. 605/. p.m. & revised to Rs 645 w.e.f. 04 June , 2013 vide OM No. 1/10/2012-P&PW(E) dated 27th June, 2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are In receipt of Ex-gratia payment of Rs. 654/-, Rs. 659/-, Rs. 703/- and Rs. 965/-.

2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee. In their application to the Indian Audit and Accounts Department, these orders issue In consultation with the  C&AG.

3. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their 0M No.1/4/EV/2004 dated 14th October,2014.
